Would the genie have the right (rite?) to habeus spiritus if wrongfully convicted? Should the court limit witnesses to those trapped in the material world, or should the genie be able to summon ginns etc for witnesses on his behalf? Magic is probably restricted in the KSA, doesn’t this keep the poor genie’s magician, advocate, lawyer, from obtaining the full cooperation of the accused in his defense? How can the judge be neutral? A ruling in favor of a criminal genie could be rewarding in the short term. Just as a ruling against could result in missing items and mysterious ailments.
Obviously, a travesty of justice no matter which way the verdict goes.
The Common Law does have the advantage of preventing this sort of thing- it would be difficult indeed to sit a jury of his peers for the trial of a member of the class: genie.
