One of the suspects in the pirate attack that led to the killings of four Americans says he was kicked and stomped by Navy crew members after his capture.
Mahdi Jama Mohamed said in a new court filing that his injuries were so severe that he needed stitches to close a wound on his chin. He also says he was blindfolded and kept in handcuffs for several days, and he thought he would be killed if he didn’t talk.
Mohamed’s lawyer argues that any statements his client made to Navy officials or the FBI should be thrown out of court…
Mohamed, who does not speak English, was captured along with the other co-defendants on Feb. 22 by the crew of the U.S. destroyer Sterett.
“Mohamed was pushed onto the ground, his back was stomped and the back of his head was kicked, resulting in bruises and a cut on his chin which required stitches,” Holmes told the judge in the filing. “The questioning of the defendant clearly was in violation of the Fifth Amendment and the supporting decisions of the Supreme Court. The statement must be deemed to be involuntary and deemed inadmissible because it was based upon coercion and undue influence.”
We should just take him back to the scene of the crime and release him.

Since we know that various terrorist leaders have taught ways to take advantage of the US legal system; I’d have to say this is very affective Asymmetric Warfare. Particularly when you have such a compliant DoJ. The question will be if the US Attorney’s Office actually responds to the motion, or does nothing hoping Judge Davis will have to compromise his appearance of objectivity and simply dismiss the arguments without a motion from the prosecution. Such an event would add fodder worth a few more years of appeal motions by the defense.

I say take him back and release him, as Lex suggests. Although the idea of letting him work for his release at Fukishima is intriguing. I mean, we might just be doing him a favor by doing so, since he wouldn’t need any battery powered lights at night afterward.

IIRC the decks of a warship are considered sovereign U.S. territory. I remember hearing that the first Papal visit to the United States is technically to be considered to have been when one of the Popes in the 19th century boarded the U.S.S. Constitution when it visited Italy.

Fifth Amendment applies to US soil, not only for citizens. Or else my mother wouldn’t have any fifth amendment rights after living here for over thrity years.

I agree. More and more, the murdered are forgotten and the perpetrators are attempted to be shown as a victim. Cruel to the kind, kind to the cruel. I am boiling over with righteous indignation about this.
Now there’s an idea. Just think how much FedGov would save if they contracted the punishment for these twits. Or, they could be sent to one of the Basic Training/ Boot Camp installations for their daily abuse. I doubt they’d last long at Parris or San Diego. At least you’d get some use out of them.

As I’ve mentioned here before, had my inheritance not been boiled away by some bad folks, I’d have been doing some single-handed sailing, which would have made me cold meat for a-holes like that. I would like to think my government would have avenged me in a swift and horrible and revoltingly exemplary manner had that guy done the same to me.

Shaman … I’ll tell you what my English teacher told me many many years ago, and I never forgot it: Being ‘hanged’ is the ultimate punishment; being ‘hung’ is a gift of God. There now … I’ll bet you’ll never confuse the two again. I know I haven’t.
